InkSpec Standard Warranty

  1. Warranty Period
    1. For InkSpec products, including but not limited to measurement components, filters, control systems, etc.: one (1) year from the date of shipment.
    2. For equipment containing moving parts, such as mixers, pumps, electromechanical/pneumatic valves, etc.: thirty (30) days from the date of shipment.
  2. Definition of the Warranty Holder
    1. The warranty holder refers exclusively to the original customer who purchased the product directly from InkSpec or an authorized reseller and holds valid proof of purchase.
    2. Any person using the product with the authorization of the warranty holder (including, but not limited to, employees, technicians, subcontractors, or other representatives) is deemed to act solely under the responsibility of the warranty holder and shall not be considered a warranty holder nor acquire any contractual rights against InkSpec.
    3. InkSpec assumes no obligation or liability toward any third party or end user who is not the warranty holder.
  3. Proof of Purchase Required
    To benefit from the warranty, the warranty holder must present a valid proof of purchase (invoice or receipt issued by InkSpec or an authorized distributor). This proof, which is non-transferable, will be required in the event of a claim.
  4. Repair Coverage
    During the warranty period, defective parts will, at InkSpec’s discretion, be repaired or replaced at no cost to the warranty holder, except for shipping and customs fees for round-trip transportation to our facility.
  5. Return Procedure
    The warranty holder who detects an issue with a product must contact InkSpec’s customer service to obtain a Return Merchandise Authorization (RMA) request. No product will be processed without prior RMA authorization.
  6. Limitation of Liability
    InkSpec disclaims all liability for direct or indirect losses resulting from the use of its equipment or any defects therein.
  7. Exclusions of Liability
    This warranty specifically releases InkSpec from any liability arising from:

    1. Loss of profits or revenue, loss of business opportunities, interruption of business operations, damage to property or equipment, as well as any other consequential, incidental, or indirect damages.
  8. Warranty Exclusions
    This warranty does not cover:

    1. Damage resulting from installation, use, or maintenance that does not comply with the manuals provided or InkSpec’s technical instructions.
    2. The breaking of the warranty seal on the equipment.
    3. Failure to follow commissioning procedures by a technician, if applicable.
    4. Damage caused by modification, alteration, abuse, or misuse of the system.
  9. Acceptance of Terms
    By purchasing this product, the warranty holder acknowledges and accepts the terms of this warranty as well as the limitations of liability set forth herein. The warranty holder also agrees to indemnify and hold InkSpec harmless from any claims, of any nature whatsoever, as well as from any loss, damage, liabilities, cost, or expense resulting from the use or misuse of the equipment.
  10. Warranty Modifications
    InkSpec reserves the right to update or modify the terms of this warranty at any time without prior notice.
  11. Repair Coverage Duration
    Any replaced or repaired equipment will remain covered under the original warranty period, calculated from the date of purchase.
  12. Exclusion of On-Site Service
    This warranty does not cover on-site service. If necessary, on-site interventions are available upon request at InkSpec’s standard service rates.
  13. Severability
    If any provision of this warranty is deemed invalid, illegal, or unenforceable by a competent court, such determination shall not affect the validity or enforceability of the remaining provisions, which shall remain in effect to the fullest extent permitted by law.
  14. Governing Law
    This warranty is governed by the laws of Canada and the Province of Quebec. Any dispute arising from this warranty shall be submitted to the exclusive jurisdiction of the competent courts sitting in the judicial district of Montréal, Province of Québec, to the exclusion of any other forum.
